Abstract
This study originated from the reality that occurs in a world of justice in Indonesia where it has occurred dualism between the Religious authority prosecute the General Court in Islamic banking disputes. This is (dualism of authority to hear) is caused because of the emergence of Act No. 21 of 2008 concerning Islamic Banking which is directly contrary to the Act No. 3 of 2006 on the Court of Religion that gives the possibility for the General Court to examine and adjudicate disputes other than courts of Islamic banking religion. As a result cause problems. First, how the dispute resolution Shariah banking in Indonesia, second, whether the Religious absolute competence is reduced and/or dualism, and the Third, how competence dispute resolution arrangements to ensure certainty of sharia banking law in Indonesia. The third problem comes after the enactment of Law Number 21 Year 2008 About Banking Shariah and Law Number 50 Year 2009 on the Religious.
