Abstract

This study aims to determine the policy of the handling toward mudaraba problematic financing with the condition of force majeure in sinarmas bank,shariah business unit, bengkulu branch. The type of the study is empiri al jurdical law study which intended to provide data and description as thoroughly as posible about the step taken by the sirnamas bank, shariah business unit,Bengkulu branch in hamdlimg the problem of mudharabah problematic financing. The location of the study was at sinarmas bank,sharia busniess unit, Bengkulu branch. Type of data used in this study are primary and secondary data, The data collection techniques are interviews and literature studies in the from of books, legislation and other documens. The data analysis technique is qualitative data analysis. from the resulst of the study, it can be concluded that the mudharabah financung policy got trouble namely the condition of the force majaure at sinarmas bank,sharia business unit which is not in accordance with right. in addition, sinarmas bank sharia business unit bengkulu branch may be penalized if it is proven to violate islamic principles. keyward: sinarmas nbank sharia business unit bengkulu branch, troubleshooting ,mudharabah agreement financing under the hand of majeure conditions.
