Abstract

Indigenous people of Bali Banjar Adat Tirte Sutekte still adhere to the customary values and culture that develop in the community, for example, nyolong semare’s customary offenses applies to couples who commit sexual intercourse outside of marriage. The urgency of this research is that Nyolong Semare is deemed offensive in Balinese indigenous peoples and this action can cause contamination of something sacred both in the scene (buano alit) and the unseen nature (buano agung) then Nyolong Semare is wider than the act of adultery which is regulated in the KUHP. The aim of the study was to describe the process of resolving the Nyolong Semare custom offenses according to the Bali Banjar Adat Tirte Sutekte, and to describe the reasons for Nyolong Semare's customary offense resolved according to customary Bali Banjar Adat Tirte Sutekte institution in Sumber Agung Village, Arma Jaya District, North Bengkulu Regency. The type of this research is empirical legal research, with qualitative research methods. The results of the study are: (1). The settlement process for Nyolong Semare custom offense according to customary Bali Banjar Adat Tirte Sutekte institution in Sumber Agung Village, Arma Jaya District, North Bengkulu Regency is preceded by the arrest / report of the pair of perpetrators of the Nyolong Semare offense, then a customary trial is held, next is the engagement event as well as determining the Wedding Day, the implementation of the Marriage Ceremony, the Village Cleansing Ceremony, the final payment of administration to the administrator of the Customary Institution (2). The reasons for indigenous people of Bali Banjar Adat Tirte Sutekte resolving Nyolong Semare customary offenses according to Bali Banjar Adat Tirte Sutekte institution institution in Sumber Agung Village, Arma Jaya District, North Bengkulu Regency are reasons based on Religion, reasons based on Fairness and reasons based on Time, in the process of resolving the Nyolong Semare customary offense, reasons for compliance with customary law, and reasons for maintaining order in society.
