Abstract

Corruption which has more than two people involved uses the doctrine of participation in determining its criminal liability. One of the decisions that uses deelneming doctrineis Decision No.51/Pid.susTPK/2017/PN.Bgl. This study aims to analyze the regulation of participation in criminal law and use analysis to find out the basis of judicial considerations from investigators in determining the perpetrators of corruption No.51/Pid.sus-TPK/2017/PN.Bgl.This type of study is normative juridical. The approaches used of this study are case, law, and a philosophical approach. The data obtained was processed by the library method and analyzed by the content analysis method with qualitative forms. The results of this study state that the doctrine of inclusion in Law No. 31 of 1999 that has been approved amended by Law No 20 of 2001 concerning Eradication of Corruption Crime only regulating in Article 15 and in the KUHP which regulated in Articles 55 and 56. There is no consider investigator juridical basic indetermining other perpetrators that were involved because of the differences in understanding of participation forms by investigators.
