Abstract

In the era of autonomy is still developing various negative phenomena such as the recently passed regulations that become effective and has not been replaced with the new regulations. Regulations that are less relevant to the needs of the community. Regulations issued by the regional government revoked the central government as opposed to higher regulations . This happens because the result of many things one of which is due to the lack of community participation in the rulemaking process areas ranging from the drafting of local regulations to the evaluation stage . To realize good local regulation, first, the Local Government shall continue to access the general principles of good Legislation into Local Regulation ; Second, the implementation of the general principles of good Legislation, covering procedures, discussion of the mechanism, the establishment and promulgation on a draft regulation to be a regional regulation. This study categorized the normative and legal research approach used in this study include the method of approach to the Act (the statute approach) , approach the case (case approach), the historical approach (historical approach), the comparative approach (comparative approach) , juridical approach empirical. The purpose of this study was to determine and analyze the principles of judicial review Formation Legislation in the formation of the Regional Regulation and Judicial Review To find society participation in the process of formation of regional regulation. In accordance with the principles of democracy, where the people's representatives in the regional and local leaders are elected directly by the people in the area, they are expected to continue to establish communication with thepeople associated with the making and determination of regional policy as outlined in the regulatory area. Provision of channels and spaces to people in the area to participate in the making and determination of local regulations is mandated by Act No. 12 of 2011 on the Establishment Regulation Legislation Article 96 .
