Abstract

Discretion is a legal ruling Based on the consideration and confidence as well as more emphasis on the moral considerations on legal considerations. The prosecutor's discretion on the basis of the provisions of Article 14 of the Criminal Procedure Code clause ( h ) and clause ( i ) formulated that : " The public prosecutor has the authority (a) decide the case in the public interest and ( b )conduct other actions in the environment other actions within the duties and responsibilities responsibility as a public prosecutor in pursuance of this Act . llegal logging is illegal logging and violate laws and regulations , in the form of timber theft in the state forest and logging or license holders over the quota stipulated in the permit. This is where the authority of the public prosecutor who use discretionary authority in penuntuttan against illegal logging crimes in accordance with the legislation in force. The purpose of this study was to determine how discretionary basis according to positive law and basic penuntuttan prosecutor in conducting the criminal prosecution of illegal logging in the country
