Abstract

Research objectives : ( 1 ) To identify and analyze the distribution of the estate of his wife after a religious court decision Curup IB Class Number : 03/Pdt.P/2010/PA . Curup . ( 2 ) To identify and analyze on the basis of consideration of the judges in the verdict Number : 03/Pdt.P/2010/PA. Curup is in conformity with the laws in force in Indonesia. The method used in this thesis using normative methods and approaches used are normative juridical approach is to examine legislation and other legal materials relating to the issues raised . After legal materials in the form of secondary data is collected by studying the documentation and other legal literature search then further data is processed first by editing and then performed a qualitative analysis .Based on the research division of wife inheritance by Court Decision Religious Curup IB Class Number : 03/Pdt.P/2010.PA . Curup , treasure is treasure that had changed the status of a wife innate inheritance . ( Alm ) Mariati Harahap Harahap married Bint Rahamat Suhardi , S.Ag , and both parents had died Mariati well in advance , then the distribution of the estate according to the Decision of the Religious wife Curup IB Class Number : 03/Pdt.P/2010 . PA . Curup Suhandri, S.Ag as husband and all siblings Mariati also inherit their inheritance in accordance with Islamic law . The consideration of the judges to look at the facts in court , to weigh and examine the evidence, has given sense of justice , expediency law and legal certainty to the parties entitled heir .
