Abstract

Land Acquisition for Plant Construction and Raw Materials In Cement Plant Seluma District in 2007, using the Presidential Regulation No. 36 Year 2005 and Presidential Regulation Number 65 of 2006 on the Amendment of Presidential Regulation No. 36 Year 2005 on Land Procurement for Development Implementation for Public Interest, in the interests of the company private. The purpose of this study was to determine the procurement of land for public purposes and the acquisition of land for development and Raw Materials Cement Factory in the District Seluma, and to investigate the process of land acquisition for the region Protected Forest (HL) and / or Limited Production Forest (HPT) for activities of interest public/private. This research approach using the law (statute approach), normative juridical approach, legal material used is of primary legal materials, legal materials and secondary legal materials tertiary. The results showed that the implementation of the land acquisition for the construct of public interest/private development interests and Raw Materials Cement Factory in the District Seluma. The conclusion from this study is that the implementation of the land acquisition for the construction of plant and Raw Materials In Cement Plant Seluma district can not be done with the above conditions, the type and purpose of development is not in the public interest but the interests of a private or commercial gain.
