Abstract
Article 22 of the Agreement on Trade-Related Aspects of Intellectual Property
Rights (TRIPS Agreement) represents a pivotal aspect of international intellectual
property law. The implementation of Article 22 requires member states to provide
adequate protection for geographical indication. In regards of geographical
indication, TRIPS Agreement aim to ensure the origin of the exported product could
be trace. Unfortunately, while the origin of the product is protected, the people
behind the product are not. The one whom wholesale the product is the most
benefited one, yet mainly those are foreign company. The small-scale farmer who
should have benefited from geographical indication are being marginalized by fixed
sell price impose by big foreign company. This research aims to measure how far
the implementation of article 22 give protection and benefit to the masses. The
research also aims to find the root problem of the injustice that happen across the
board. In hope finding a befitting solution toward resolving the problem.
