Abstract

Waqf is one of the instrument that can build moslems’ social economic lives.Cash waqf is a waqf done by a person, group of people, and department or law firm in the form of money. The regulation used to control cash waqf in Indonesia is Undang-undang Number 41 Year 2004 about Waqf. In Malaysia, cash waqf arranged in Enakmen Pentadbiran Agama Islam (Negeri Johor) years 2003. This research was normatif research. Researccher conducted the research through out Law Regulation, Books, Article and journal, internet and used it as reference to obtained data.The result of the research is the regulation of cash waqf in Indonesia was arranged in Undang-undang Nomor 41 Tahun 2004 about Waqf and Undang�undang Nomor 42 Tahun 2006 about the implementation of Undang-undang Nommor 41 Tahun 2004 about Waqf. While waqf regulation in Malaysia arranged in Enakmen Pentadbiran Agama Islam (Negeri Johor) Tahun 2003. Both regulations gave definition, purposes, and regulation of waqf where every registration of cash waqf must be registered by Pejabat Pembuat Ikrar Waqf (PPAIW) while in Malaysia, the regulation and implementation of waqf was controlled by Majelis Agama in each country. Majelis Agama Islam Negeri (MAIN) is the only organizer of waqf property in Malaysia which was stated trough laws in every country in Malaysia. But, the implementation of waqf in both nations had differences in fund raising method. In Indonesia, there were 3 method, they are; general pattern fund raising, spesific pattern fund raising and the build of waqf center building. While in Malaysia, the method were; the term of “picking ball” and “waiting ball”. Keywords: Cash Waqf, fund raising
