Abstract

In the Protection of Women and Children unit, the Bengkulu police station has implemented Restorative Justice in resolving sexual crimes against children, but in its implementation it has not been in accordance with the provisions of the Act. Peace implementation is not before Unit Protection of Women and Children investigators, therefore the results of peace are often not fulfilled / denied by suspects / perpetrators. Therefore this topic is very important to be discussed with the aim of describing the implementation of Restorative Justice, the obstacles faced by Bengkulu Police Unit Protection of Women and Children Investigators and the efforts of Investigators in the Bengkulu Regional Police Unit Protection of Women and Children so that the Restorative Justice Implementation is effective in Handling Child Sex Crimes. This study uses empirical legal research methods, the data used are primary data, secondary data and tertiary data. The population in this study were all Unit Protection of Women and Children investigators and investigators as well as all Parties who had dealt with the Bengkulu Police Unit Protection of Women and Children, analyzing the data using a qualitative descriptive method in which systematically describing data into sentences based on statements obtained from the results of research in the field. The implementation of Restorative Justice in the Bengkulu Police Unit Protection of Women and Children involving P2TP2A, Peksos, Victim / Acting Families, Bhabinkamtibmas and by making a peace letter then carried out further examinations (minutes of report revocation), the basis of investigators carrying out Restorative Justice namely police discretion (Article 18 Law Number 2 of 2002) and the mandate of Law No. 11 of 2012 concerning the Criminal Justice System of Children which assigns the best interests to children, while the obstacles of investigators in the Implementation of Restorative Justice are Unit Protection of Women and Children Investigators cannot continue reports that have been revoked / published (SP3) but it can be submitted with a new case, namely a Fraud case if the offender denies the agreement contained in the peace letter, and the efforts made by the investigator in the implementation of Restorative Justice, namely legal counseling, coordination between law enforcement officials and education and training conducted by the Bengkulu Police Unit Protection of Women and Children Keywords: Implementation, Restorative Justice, Protection of Women and Children
