Abstract

Provisions on legal evidence instructions contained in article 184 of the Criminal Procedure Code and article 188 Criminal Procedure Code, but in practice the instructions of evidence used by prosecutors in their demands, while according to Article 188 paragraph (3) an assessment of the evidence by the judge guidance only. The problem is what is the basis for the Public Prosecutor to use clues and evidence how the evidence criteria extensible instructions used by the Public Prosecutor. The purpose is to find out what the legal basis for the use of evidence in the instructions by the Public Prosecutor in the jurisdiction of its claim in the District Court of Bengkulu and to find out how the instructions of evidence strength criteria used by the Prosecution in its claim in the District Court of jurisdiction Bengkulu. The results showed that the legal basis for the use of evidence in the instructions by the Public Prosecutor in the jurisdiction of its claim in the District Court of Bengkulu is: a) Article 183 of the Criminal Procedure Code. b) Article 188 Paragraph (1) Criminal Procedure Code. Then the hints of evidence used by the public prosecutor in a new claim to have strength of evidence if it has met the criteria derived from witness statements, letters and testimony of the defendant who has been in accordance with the provisions of their respective evidence.
