Abstract

A marriage has aimed to continue the generation or descent, but some families
can’t get the child as their generation. Usually the couple do adoptions in order
to brighten their home life and get a family successor. Therefore they do
adoptions in order to brighten their home lives and families. Besides visits of Law
No. 4 of 1979 on Child Welfare Article 12 paragraph (1) and (3) the purpose of
adoption is for the welfare and protection of children, especially children who are
displaced and need special protection. National constitution No. 35 of 2014 on
Protection of Children as norms governing about adoption mentioning adoptions
are the last, which can only be done in the best interest of children. For the
implementation of the adoption of the necessary supervision of the Department of
Social Welfare as the competent agency giving recommendations. However, in the
implementation of adoption procedures have been carried out as stipulated in the
legislation specifically related to granting permission on adoption. There are
requirements/criteria for prospective adoptive parents as well as the supervision
of the foster parents who have not been met by the Department of Social Welfare.
What this means children are not getting their rights and discrimination after
being picked. To answer these problems the method used is empirical juridical.
From the research is still a violation of law which includes the
criteria/requirements in the adoption and supervision of the prospective adoptive
parents who do adoptions. Social Office still issuing permits even though the
criteria are not met. The adoptive parents who do adoptions are those who
already have children, and more than one child, in addition to the supervision of
the Department of Social Welfare to the adoptive parents as well as home visits
(home visit) have not been fully carried out due to constrained operating funds,
Implementation of the rights of adopted children committed by foster parents in
the city of Bengkulu is still difficult to do, because the parents who adopt a child
the majority had children, resulting in violations of the rights of adopted children
to be protected from discrimination while in the care of foster parents still
happening.
