PEMBATALAN PERJANJIAN JUAL BELI SAPI AKIBAT TERJADINYA WABAH PMK DI DESA BUMI MULYA KECAMATAN PENARIK KABUPATEN MUKOMUKO

Buying and selling is a form of agreement. An agreement is an event where
one person promises another person or where two people promise each other
to carry out something. A sale and purchase agreement that has met the legal
requirements of the agreement as per Article 1320 of the Civil Code, has
legal force and is fully applicable as the law for all parties involved in its
creation Cancellation of an agreement is a statement of the cancellation of a
legal action on the demands of the parties who by law, are justified to
demand such cancellation This research aims to find out the legal
consequences that arise for the parties from the cancellation cattle sale and
purchase agreement due to FMD outbreak in Bumi Mulya village, Penarik
district, Mukomuko regency. The research method used in this study is an
empirical legal research method, data is collected through observation
peoses and direct interviews with research samples. The sale and purchase
agreement is considered to have taken place between the two parties,
immediately after these people reach an agreement on the object and its
price, even though the object has not been handed over, nor the price has not
been paid. Cancellation of a sale and purchase can basically be done by the
seller or buyer. This action will have certain legal consequences for both
parties. The cancellation of the agreement clearly has legal consequences for
the seller and the buyer, the cancellation of the cattle sale and purchase
agreement is not solely due to the fault of the cow owner, but the default that
occurs due to non-fulfillment which is the object of the agreement due to the
existence of force majeure, where this force majeure situation cannot be
predicted and is not written in the agreement.
